ORDINANCE # 19-6 ORDINANCE REGULATING GARBAGE, JUNK AND OTHER SIMILAR NUISANCES WHEREAS, the Town Council of the Town of Royal Center, Indiana, believes it is in the best interest of the citizens of the Town of Royal Center that all properties within the town limits be maintained in a clean, orderly, and respectable manner; and WHEREAS, the Town Council of the Town of Royal Center, Indiana, finds it to be in the best interest of the citizens of the Town of Royal Center that an ordinance be passed regulating garbage, junk, and/or similar nuisances and that said ordinance prescribe penalties for such activities; NOW THEREFORE, IT IS HEREBY ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF ROYAL CENTER, INDIANA, AS FOLLOWS: It shall be unlawful for any person owing or in possession of real estate within the corporate limits of said town to allow and permit garbage, junk, and/or other similar nuisances to accumulate thereon; Such garbage, junk, and/or similar nuisances shall be hauled away at any time upon the written order of the Town Councilor notice of said violation being provided, in writing, by the Town Marshall or Deputy Town Marshalls. The Town Council/Town Marshall shall fix a reasonable time limit of not less than 15 days during which said garbage, junk, and/or similar nuisances shall be removed. If any such owner or person in possession of such real estate after having been duly ordered as provided herein shall fail or refuse to obey such order, it shall be the duty of the Town Board of Royal Center to cause the work to be done to alleviate such condition. The expense thereof shall be a municipal lien on the property. In addition, a separate penalty shall be assessed at the rate of $20.00 per day for each day that the property is not in compliance with the terms of this Ordinance, beginning the first day after the removal period as established in the written order referenced above. The accumulation of penalties herein shall also effectuate a municipal lien on the property in question. The passage ofthis ordinance is intended to effectuate the cancellation of Ordinance #2012-03 (Ordinance Regulating Garbage, Junk and Other Similar Nuisances). Starting on October 7, 2019 the Lebanon Utility Water Department will begin their annual fall flush. We will begin on the north side of the water system and work our way south. This process takes between 10-15 business days, depending on the weather and should conclude around October 25, 2019. The reasons for conducting the flushing are to check and maintain water quality and to also make sure that hydrants are operating correctly for fire protection. The water that will be exiting the hydrants will be under high pressure and can be dangerous. Please avoid areas where workers are flushing. Homes and businesses that are in the flushing area may experience a slight drop in water pressure but only for a short period of time. The Lebanon Utility Facebook page and website will have an approximant schedule for flushing. I have attached a map that shows the areas and dates workers will be flushing. No.: 1700725) The Town of Clarksville is planning to undertake a road reconstruction project, funded in part by the Federal Highway Administration (FHWA) with administrative oversight from the Indiana Department of Transportation (INDOT). The project is located along Riverside Drive beginning at the entrances to Ashland Park and continuing east/southeast to the town limits of the City of Jeffersonville. Under the preferred alternative, the proposed project will reconstruct about 1,400 feet of Riverside Drive and will include the addition of on-street parking, street-scaping amenities, sidewalks, and storm sewer upgrades. A multi-use path will be added along the south side and will complete Clarksville's portion of the Ohio River Greenway. Street lighting, trees, and benches are expected to be added to the corridor. Minor approach work at the intersections with Woerner Avenue and Market Street will involve adding Americans with Disabilities Act (ADA)-compliant curb ramps with marked crosswalks. Permanent and temporary right-of-way is required for this project. Properties listed in or eligible for the National Register of Historic Places (NRHP) located within the Area of Potential Effects (APE) include the Louisville Municipal Bridge (Indiana Historic Sites and Structures Inventory [IHSSI] No.: 019-446-58215; NR-0681), Ohio Falls Car and Locomotive Company Historic District (IHSSI Nos.: 019-446-61001 to 019-446-641017; NR-2081), House at 519 Riverside Drive (IHSSI No.: 019-446-64205), and the Jeffersonville-Clarksville Levee System (WA 1). The proposed action impacts properties listed in or eligible for the NRHP. FHWA has issued an Adverse Effect finding for the project based on the fact that the project's effect on archaeological resources is not yet known.
