NOTICE OF ADOPTION OF A DECLARATORY RESOLUTION ADOPTED BY THE PARK AND RECREATION BOARD OF THE PARK DISTRICT OF THE TOWN OF ZIONSVILLE, INDIANA, AND OF A PUBLIC HEARING THEREON, AND OF A PUBLIC HEARING ON THE APPROPRIATION OF THE PROCEEDS OF THE PROPOSED SERIES C BONDS OF THE DISTRICT TO FINANCE CERTAIN PARK PROJECTS Notice is hereby given that on September 11, 2019, the Park and Recreation Board (the Board), governing body of the Park District of the Town of Zionsville, Indiana (the District), adopted a declaratory resolution (the Declaratory Resolution) determining that it is necessary for the public health and welfare and will be of public utility and benefit to undertake certain projects in the District, including all or any portion of various trail way improvements throughout the District and improvements related thereto, including without limitation, improvements to the Big-4 Rail Trail (the Series C Project). The estimated cost of the Series C Project, including costs of all work to be performed thereunder, and all acquisitions necessary to carry out the Series C Project, and other necessary expenses in connection therewith, including the issuance of bonds therefor, is $4,884,334. A copy of the Declaratory Resolution and the general plans and estimates are on file and open to public inspection in the Zionsville Town Hall, located at 1100 West Oak Street, Zionsville, Indiana. Notice is further given that on October 9, 2019, at 7:00 p.m. (local time) in the Council Chambers Room 105 of the Zionsville Town Hall, located at 1100 West Oak Street, Zionsville, Indiana, the Board will conduct a public hearing at which it will receive or hear remonstrances from persons interested in or affected by the proceedings related to the Declaratory Resolution. At the time fixed for the hearing or at any time prior thereto, any person owning real or personal property located within the District or any owner of land injuriously affected under the terms of the Declaratory Resolution may file a written remonstrance with the Board. At such hearing, the Board will hear all persons interested in the proceedings and consider all remonstrances that have been filed. After the public hearing and considering any evidence presented, the Board will then take final action determining the public utility and benefit of the Series C Project by confirming, modifying and confirming, or rescinding the Declaratory Resolution. The taxpayers of the District are further notified that the Board did on September 11, 2019, determine to issue special taxing district bonds of the District, in one or more series, in an original aggregate amount not to exceed $4,305,000 (the Series C Bonds), for the purpose of financing all or any portion of the costs of the Series C Project, and that the Board will hold a public hearing on October 9, 2019, at 7:00 p.m. (local time) in the Council Chambers Room 105 of the Zionsville Town Hall, located at 1100 West Oak Street, Zionsville, Indiana, on the matter of issuing the Series C Bonds and appropriating the proceeds thereof together with interest earnings thereon. Said appropriation is in addition to all appropriations provided for in the existing budget and tax levy. Funds to cover said appropriation are to be provided from the proceeds of the Series C Bonds and interest earnings thereon.
