NOTICE OF PUBLIC HEARING ON PROPOSED AMENDMENT TO ZONING ORDINANCE ORDINANCE NO. ____ AMENDMENT NO. ______ TO ORDINANCE NO. 17-2007 NOTICE IS HEREBY GIVEN THAT THE Clark County Plan Commission, on April 13th, 2016 at 5:00 p.m. in Room 418, Fourth Floor, West Wing, Clark County Government Building, 501 East Court Avenue, Jeffersonville, Indiana, will hold a public hearing to consider and act upon a proposed Amendment to the Clark County, Indiana Zoning Ordinance. The geographic areas to which the proposed ordinance applies is all unincorporated areas of Clark County, Indiana, and any incorporated areas that have elected to grant Clark County Zoning Jurisdiction over such areas. The following is a summary of the proposed Amendment: A. Article XXVIII (28): Lighting Standards - is added in place and to read as follows: "Lighting Standards - The purpose of lighting standards is to provide: 1. Regulations for outdoor lighting that provide illumination practices for night-time safety, utility, security, productivity, enjoyment, and commerce. 2. Minimize adverse offsite impacts of lighting such as light trespass, and obtrusive light. 3. Curtail light pollution, reduce skyglow and improve the nighttime environment for wildlife & astronomy. 4. Help protect the natural environment from the adverse effects of night lighting from gas or electric sources. 5. Conserve energy and resources to the greatest extent possible. Definitions: Footcandle - The unit of measure expressing the quantity of light received on a surface. One footcandle is the illuminance produced by a candle on a surface one foot square from a distance of one foot. Fully Shielded Luminaire - A luminaire constructed and installed in such a manner that all light emitted by the luminaire, either directly from the lamp or a diffusing element, or indirectly by reflection or refraction from any part of the luminaire, is projected below the horizontal plane through the luminaire's lowest light-emitting part. Landscaping Lighting - Lighting of trees, shrubs, or other plant material as well as ponds and other landscape features. Light Pollution - Any adverse effect of artificial light including, but not limited to, glare, light trespass, skyglow, energy waste, compromised safety and security, and impacts on the nocturnal environment. Lumen - The unit of measure used to quantify the amount of light produced by a lamp or emitted from a luminaire (as distinct from "watt," a measure of power consumption) Luminaire - The complete lighting unit (fixture), consisting of a lamp, or lamps and ballast(s) (when applicable), together with the parts designed to distribute the light (reflector, lens, diffuser), to position and protect the lamps, and to connect the lamps to the power supply. Landscaping Lighting - Lighting of trees, shrubs, or other plant material as well as ponds and other landscape features. All outdoor lighting shall be installed in conformance with the provisions of this Ordinance, applicable Electrical and Energy Codes, and applicable sections of the Building Code. All outdoor lighting installed after the date of effect of this Ordinance shall comply with these requirements. This includes, but is not limited to, new lighting, replacement lighting, or any other lighting whether attached to structures, poles, the earth, or any other location, including lighting installed by any third party. The following are not regulated by this Ordinance: 1. Lighting for public monuments and statuary 2. Temporary lighting for theatrical, television, performance areas and construction sites; 3. Underwater lighting in swimming pools and other water features 4. Temporary lighting and seasonal lighting. 5. Lighting that is only used under emergency conditions A. General Requirements for Residential Lighting including multiple residential properties not having common areas, all outdoor luminaires shall be fully shielded and shall not exceed 1,260 lumens. Exceptions: - One partly shielded or unshielded luminaire at the main entry, not exceeding 630 lumens. - A low voltage landscape lighting luminaire aimed away from adjacent properties and does not exceed 2,100 lumens. - A shielded directional flood lighting luminaire aimed so that direct glare is not visible from adjacent properties and does not exceed 2,100 lumens. - Unshielded luminaires that do not exceed 315 lumens excluding main entry luminaire. - Open flame gas lamps. - Lighting required by federal, state, territorial, and laws or regulations. - Lighting installed with a vacancy sensor, where the sensor extinguishes the lights no more than 15 minutes after the area is vacated. B. Requirements for Commercial Lighting 1. All lighting shall be shielded with opaque material to prevent direct lighting on streets, alleys, and adjacent properties. 2. All lighting shall meet adopted electrical and energy codes. 3. All lighting elements used to cast light on building facades, features of buildings or signs shall have cutoff luminaires with less than a ninety-degree (90) angle - "down lighting". 4. All parking lot lights shall have cutoff luminaires with less than a ninety-degree (90) angle (down lighting) and may be no more than twenty (20) feet in height. 5. All freestanding lights and lights mounted on walls or facades must have cutoff luminaires with less than a ninety-degree (90) angle. 6. Lighting from a property may not cause more than a one-half (1/2) foot candle of illumination beyond the property line of that property. The only exception to this standard is as follows: a. When the subject property is zoned for business use and the adjacent property is also zoned for business or industrial use, then the allowable light at the property line is one (1) foot candle (only on the sides of the property that are adjacent to the similar Zoning District). b. When the subject property is zoned for industrial use and the adjacent property is also zoned for industrial use, then the allowable light at the property line is two and one half (2 ^) foot candles (only on the sides of the property that are adjacent to the similar Zoning District) Any new residential & commercial lighting shall meet the requirements of this Ordinance. Written objections or comments to the proposed Amendment may be filed with the Plan Commission before such hearing, will be heard at the specified time and place and will be considered. Oral comments concerning the proposal will also be heard. Said hearing may be continued from time to time as may be necessary. A copy of the proposed Amendment is available for public inspection during regular business hours in the office of the Clark County Plan Commission, Room 416, Fourth Floor, West Wing, Clark County Government Building, 501 E.
