INVITING SEALED PROPOSALS FOR THE RECONSTRUCTION OF THE SMALL REGULATED TILE DRAIN Pursuant to I.C. 36-9-27-78 The Boone County Drainage Board, Boone County, Indiana will receive sealed bid proposals until the hour of 8:30 a.m. on October 17, 2016 in the Boone County Surveyor's Office, 116 West Washington Street, Room 102, Lebanon, IN 46052, for the Reconstruction of Small Regulated Tile Drain. Each bid shall be submitted in a sealed envelope, identified as Bid for Reconstruction of Small Regulated Tile Drain, shall bear the name and address of the bidder and must be filed in the office of the County Surveyor prior to the specified time of the bid opening. As required by I.C. 36-9-27-78(c), at the above stated time, all bids will be publicly opened and read aloud in the Commissioner's Room of the Boone County Office Building, 116 West Washington Street, Lebanon, Indiana. Any bid received after the designated time will be returned unopened. Pursuant to I.C. 31-9-27-78(a)(4) copies of the plans and specifications are available for the inspection to interested bidders in the office of the Boone County Surveyor. As required by I.C. 36-1-12-4(b)(2) copies of the plans and specifications are also on file and available for examination in the office of the Boone County Auditor, 201 Courthouse Square, Lebanon, Indiana. Bids shall be submitted on a fully and properly executed General Bid Form 96 as prescribed by the Indiana State Board of Accounts and in accordance with I.C. 36-1-12-4(b)(6) and all acts amendatory thereto and shall include the required Plan & Equipment Questionnaire and Contractor's Financial Statement. The bid shall also include an executed Non-Collusion Affidavit as required by I.C. 36-1-12-4(b)(12), and shall include an executed Non-Discrimination Clause and Certificate of Non-Segregated Facilities. Pursuant to I.C. 36-9-27-78(b), each bidder shall be required to file with his bid proposal, at his option, either a certified check made payable to the Boone County Drainage Board in the sum of five percent (5%) of the total bid proposal or an acceptable bid bond in the amount of five percent (5%) of the total bid proposal. If a bidder elects to deposit a bid bond, the bond must be payable to the Boone County Drainage Board with sufficient sureties, and the bond must be conditioned upon the bidder's execution of a contract in accordance with his bid if accepted by the Board and must provide for the forfeiture of five percent (5%) of the amount of the bid upon his failure to do so. The Boone County Drainage Board shall return all checks or bonds submitted by unsuccessful bidders. The check or bond submitted by the successful bidder or bidders shall be returned upon entering into a contract with the Boone County Drainage Board. Pursuant to I.C. 36-1-12-6(a) the Boone County Drainage Board shall award the contract and shall provide the successful bidder with written notice to proceed within sixty (60) days after the date on which the bids are opened. Pursuant to I.C. 36-1-12-6(d) failure to award and execute the contract and to issue the notice to proceed within the sixty (60) day time limit required by I.C. 36-1-12-6(a) entitles the successful bidder to: (1)Reject the contract and withdraw his bid without prejudice; or (2)Extend the time to award the contract and provide notice to proceed at an agreed later date. If the successful bidder elects to reject the contract and withdraw his bid, notice and that election must be given to the Boone County Drainage Board in writing within fifteen (15) days of the sixty (60) day expiration date or any other extension date. Pursuant to I.C. 36-9-27-78(e), upon execution of the contract, the successful bidder shall give to the Boone County Drainage Board an acceptable performance bond payable to said Board, in the amount of One Hundred Percent (100%) of the bid proposal. The bond must be conditioned on the faithful performance of the contract and the payment of all expenses and damages incurred under the contract, including payment of all suppliers, laborers, and subcontractors. The surety on the performance bond shall not be released until one (1) year after the date of the Board's final settlement with the Contractor. The performance bond must specify that: (1)A modification, omission, or addition to the terms and conditions of the contract, plans specifications, drawings, or profile; (2)A defect in the contract; or (3)A defect in the proceedings preliminary to the letting and awarding of the contract does not discharge the surety. Pursuant to I.C. 36-1-12-13.1, an acceptable payment bond in the amount of One Hundred Percent (100%) of the contract amount, payable to the Boone County Drainage Board shall be required of the successful bidder. The payment bond is binding on the Contractor, the subcontractor, and their successors and assigns for the payment of all indebtedness to a person for labor and service performed, material furnished, or services rendered. The payment bond shall state that it is for the benefit of the subcontractors, laborers, material suppliers, and those performing services. The payment bond shall be deposited with the Board. The payment bond must specify that: (1)A modification, omission, or addition to the terms and conditions of the contract, plans, specifications, drawings, or profile; (2)A defect in the public work contract; or (3)A defect in the proceedings preliminary to the letting and awarding of the contract; does not discharge the surety. The surety of the payment bond may not be released until one (1) year after the Board's final settlement with the Contractor. A PRE-BID CONFERNCE WILL BE HELD WEDNESDAY, OCTOBER 5, 2016 AT 9:00 A.M.
