NOTICE OF PUBLIC HEARING BY THE TOWN OF ZIONSVILLE BOARD OF ZONING APPEALS Notice is hereby given of a Public Hearing to be held by the Town of Zionsville Board of Zoning Appeals on Tuesday, September 10, 2019, at 6:30 p.m. in the Zionsville Town Hall, 1100 West Oak Street, Zionsville, Indiana 46077 to consider the following Petition: 2019-21-UV / 2019-23-DSV / 2019-22-SE Hopwood Cellars Winery requests a USE VARIANCE, DEVELOPMENT STANDARDS VARIANCE, SPECIAL EXCEPTION to provide for or permit: Petition for a Use Variance in order to provide for the construction and operation of a new Winery, Distillery & Event Center to: 1) Deviate from the allowed intended uses in an Agricultural Zoning District and the Rural Michigan Road Overlay District (AG & MRO). Petition for Development Standards Variance to allow for the construction and operation of a new Winery, Distillery and Event Center, located in both the Agricultural (AG) and Rural Michigan Road Overlay (MRO) Zoning Districts to: 1. Deviate from the MRO requirements specific to accessory use standards 2. Exceed the AG maximum height requirement. Petition for Special Exception to allow existing residential building(s) to remain in an Agricultural Zoning District and the Rural Michigan Road Overlay District (AG & MRO). The property involved is more commonly known as 2055 & 2201 S US 421 Zionsville Indiana 46077, and is legally described as: EXHIBIT A Parcel I: A part of the North Half of Section 14, Township 18 North, Range 2 East, Union Township, Boone County, Indiana, more fully described by: Commencing at the Northeast Corner of the North Half of said Section 14, thence South 89 degrees 06 minutes 44 seconds West along the section line and the approximate centerline of County Road 200 S a distance of 2809.86 feet to the point of beginning; thence South 00 degrees 53 minutes 16 seconds East, 372.60 feet; thence South 66 degrees 23 minutes 47 seconds West, 284.55 feet along a partial fence line; thence North 20 degrees 29 minutes 54 seconds West along the centerline of U. S. Highway No. 421 a distance of 502.39 feet; thence North 89 degrees 08 minutes 44 seconds East along the Section line and the approximate centerline of County Road 200 S a distance of 434.76 feet to the point of beginning, containing 3.5000 acres, more or less, subject to an easement for County Road 200 South on and along the entire North boundary and subject to a right of way for U. S. Highway No. 421 on and along the westernmost boundary, together which contains 0.7395 of an acre, more or less. Parcel II: A part of the North Half of Section 14, Township 18 North, Range 2 East, Union Township, Boone County, Indiana, more fully described by: Commencing at the Northeast Corner of the North Half of said Section 14; thence South 89^06'44 West, along the Section line and the approximate centerline of County Road 200 South, a distance of 1976.16 feet to the Point of Beginning; thence South 00^06'52 West, a distance of 825.21 feet; thence South 89^06'44 West, along the South described line of the Mattingly Property, as recorded in Deed Record 235, Page 671, a distance of 960.06 feet; thence North 20^29'54 West, along the approximate centerline of U.S. Highway 421, a distance of 373.49 feet; thence North 68^23'47 East, along the South described line of the Mattingly and Sullivan Properly, as recorded in Deed Record 235, Page 45, a distance of 284.55 feet; thence North 00^53'16 West, along the East described line of said Mattingly and Sullivan Property, a distance of 372.60 feet; thence North 89^06'44 East, along the Section line and the approximate centerline of County Road 200 South, a distance of 833.70 feet to the Point of Beginning, containing 17.6050 Acres, more or less, being subject to the Right of Way of U.S. Highway 421, on and along the Southwesterly Boundary and also subject to the Right of Way of County Road 200 South, on and along the entire Northernmost Boundary. A copy of the Petition for USE VARIANCE, DEVELOPMENT STANDARDS VARIANCE, SPECIAL EXCEPTION, and all plans pertaining thereto are on file and may be examined prior to the Public Hearing from 8:00 a.m. to 4:00 p.m. Monday through Friday, except for Holidays, in the Planning & Economic Development Department in the Zionsville Town Hall, 1100 West Oak Street, Zionsville, Indiana, 46077. Written comments in support of or in opposition of the Petition that are filed with the Secretary of the Town of Zionsville Board of Zoning Appeals prior to the Public Hearing will be considered. The Public Hearing is open to the public. Oral comments to the Petition for USE VARIANCE, DEVELOPMENT STANDARDS VARIANCE, SPECIAL EXCEPTION, will be heard at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary. Upon request, the Town of Zionsville will provide auxiliary aids and services.
