NOTICE OF REAL PROPERTY TAX SALE Ripley County Indiana Beginning 10:00 AM, 10/31/2019 Commissioners' Room Local Time Ripley County Pursuant to the laws of the Indiana General Assembly, notice is hereby given that the following described property is listed for sale for delinquent taxes and/or special assessments. The county auditor and county treasurer will apply on or after 10/14/2019 for a court judgment against the tracts or real property for an amount that is not less than the amount set out below and for an order to sell the tracts or real property at public auction to the highest bidder, subject to the right of redemption. Any defense to the application for judgment must be filed with the Ripley County Superior Court and served on the county auditor and treasurer before 10/14/2019. The court will set a date for a hearing at least seven (7) days before the advertised date of sale and the court will determine any defenses to the application for judgment at the hearing. The county auditor and the county treasurer are entitled to receive all pleadings, motions, petitions, and other filings related to the defense to the application for judgment. If the real property is sold in the tax sale, the amount required to redeem such property will be 110% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed not more than six (6) months after the date of sale, or 115% of the minimum bid for which the tract or real property was offered at the time of sale, if redeemed more than six (6) months after the date of sale, plus the amount by which the purchase price exceeds the minimum bid on the real property plus five percent (5%) per annum interest on the amount by which the purchase price exceeds the minimum bid on the property. In addition, IC 6-1.1-25-2 (e) states the total amount required for redemption may include the following costs incurred and paid by the purchaser or the purchaser's assignee or the county before redemption: (1) The attorney's fees and cost of giving notice under IC 6-1.1-25-4.5; (2) The costs of title search or examining and update the abstract of title for the tract or item of real property. The period of redemption shall expire on Monday, November 02, 2020 for certificates sold in the tax sale. For certificates struck to the county, the period of redemption may expire Friday, February 28, 2020. If the tract or item of real property is sold for an amount more than the minimum bid and the property is not redeemed, the owner of record of the property who is divested of ownership at the time the tax deed is issued may have a right to the tax sale surplus. BOONE COUNTY COUNCIL ORDINANCE NO. 2019-01: AN ORDINANCE ESTABLISHING COST OF REPRODUCTION OF VIDEO PUBLIC RECORDS WHEREAS, the Boone County Council (Council) is the fiscal body for Boone County as codified in Indiana Code 38-1-2-6 and 36-2-3-2; and WHEREAS, Indiana law provides for access to public records through the Access to Public Records Act (APRA), as codified in I.C. 5-14-3; and WHEREAS, Boone County owns and maintains various video cameras and recordings of the video images captured by those cameras, including video recordings at County facilities and video cameras worn by Officers of the Boone County Sheriff's Office; and WHEREAS, APRA designates that portions of those video recordings are public records subject to reproduction and disclosure to the public, after review and redaction to remove or obscure protected or confidential material contained in the recording, as codified in I.C. 5-14-3-6; and WHEREAS, upon receiving an APRA request for video recordings or images, Boone County must assign a qualified and trained employee to review the video images and remove and/or obscure any non-disclosable images, as defined in I.C. 5-14-3-4; and WHEREAS, study and analysis from the Federal Bureau of Investigation have demonstrated that eight to twelve man-hours is required to review and redact each hour of video released publicly; and WHEREAS, The Boone County Sheriff has designated an employee with sufficient skills, expertise and knowledge to perform the necessary review of video extracts and files, and to redact and/or obscure non-disclosable information, currently holding the rank of Sergeant in the merit system; and WHEREAS, including benefits, the cost to Boone County for the necessary review of video files and extracts, is approximately One Hundred Dollars ($100) per hour; and WHEREAS, The Council believes it is reasonable to set a fee of Five Hundred Dollars ($500) to produce each video file or extract in compliance with Indiana law, as recited above. NOTICE TO TAXPAYERS REGARDING A DETERMINATION OF THE WESTERN SCHOOL CORPORATION, HOWARD COUNTY, INDIANA, TO ENTER INTO A PROPOSED AMENDMENT TO LEASE AGREEMENT OF THE EXISTING WESTERN HIGH SCHOOL The taxpayers of the Western School Corporation, Howard County, Indiana (the School Corporation), are hereby notified that on September 17, 2019, the Board of School Trustees of the School Corporation (the Board) did adopt a resolution determining that the School Corporation will take all actions necessary to enter into an amendment to lease agreement of the existing Western High School, its related outdoor facilities and the real property upon which any portion of the Western High School or its related outdoor facilities are located (the 2019/2020 Amendment to Lease) with the Western School Building Corporation, which is a nonprofit school building corporation controlled by, and operating on behalf of, the School Corporation (the Building Corporation), which in turn will allow the Building Corporation to issue (a) one or more series of first mortgage bonds to pay for all or a portion of the costs of the 2019/2020 Primary/Intermediate School Facility Improvement Project, as defined in the resolution of the Board adopted on September 17, 2019 (collectively, the 2019/2020 Primary/Intermediate School Facility Improvement Project Bonds), and (b) one or more series of first mortgage bonds to pay for all or a portion of the costs of the 2019/2020 Middle/High School Facility Improvement Project, as defined in the resolution of the Board adopted on September 17, 2019 (collectively, the 2019/2020 Middle/High School Facility Improvement Project Bonds)(the 2019/2020 Primary/ Intermediate School Facility Improvement Project Bonds and the 2019/2020 Middle/High School Facility Improvement Project Bonds, collectively, the Bonds), each series of such Bonds payable from the lease rentals received from the School Corporation pursuant to the terms of the Lease Agreement, dated as of May 4, 2006, as previously amended and as further amended by the 2019/2020 Amendment to Lease (collectively, the Lease). Pursuant to the proposed amendment to Lease, the Building Corporation will do all or any portion of the following: (1) Continue to lease to the School Corporation all of the premises subject to the Lease, which is the existing Western High School and its related outdoor facilities, certain adjacent facilities and outdoor physical education/extra-curricular facilities and the land upon which such facilities are located, all of which are located in Howard County, Indiana (the Premises); (2) Reimburse the School Corporation for costs previously incurred by the School Corporation for one or more facility improvement, renovation or equipping projects at all or any portion of the Premises; (3) Undertake all or any portion of each of the 2019/2020 Projects; and (4) Extend the term of the Lease with respect to all or any portion of the Premises, with an increased term not to exceed fourteen (14) years from the date the proposed amendment to the Lease is recorded by the Building Corporation and the School Corporation (which is an additional five (5) years from the current final term of the Lease, assuming the proposed amendment to the Lease is recorded in 2020), with an increased annual lease rental not to exceed Three Hundred Twenty-Five Thousand Dollars ($325,000) with respect to 2019/2020 Primary/Intermediate School Facility Improvement Project Bonds and not to exceed Three Hundred Forty-Five Thousand Dollars ($345,000) with respect to 2019/2020 Middle/High School Facility Improvement Project Bonds, with all of such additional annual lease rentals payable in semiannual installments commencing no earlier than June 30, 2020, and thereafter on June 30 and December 31 of each year during the remaining term of the proposed amendment to Lease. As additional rental, the Lessee will maintain insurance on that portion of the Premises which is subject to the Lease as required in the Lease and will pay all taxes and assessments against such property, as well as the cost of alterations and repairs, all rebate costs associated with the obligations issued by the Building Corporation, and all utility costs incurred in connection with such property. Simultaneous with the issuance of each series of the 2019/2020 Bonds, the annual lease rental will be reduced to an amount equal to an amount sufficient to pay the principal and interest due on all of the Bonds outstanding after the issuance of such 2019/2020 Bonds in each twelve-month period together with annual incidental costs as determined by the Building Corporation at the time of the issuance of each such series of the 2019/2020 Bonds, payable in semiannual installments. The Lease gives an option to the Lessee to purchase that portion of the Premises which is subject to the Lease. As stated above, the Building Corporation will be paying the School Corporation (a) as reimbursement for improvements made at the Premises since the Building Corporation has owned the Premises which were paid by the School Corporation, and (b) for an extension of the Building Corporation's ownership of the Premises. The School Corporation intends to use the money it receives, if any, from the proceeds of the 2019/2020 Primary/Intermediate School Facility Improvement Project Bonds to pay for that portion of the 2019/2020 Primary/Intermediate School Facility Improvement Project not paid by the Building Corporation.
