NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that the Zionsville Board of Zoning Appeals will conduct a Public Hearing on Tuesday, May 10, 2016 at 6:30 p.m. in the Zionsville Town Hall, 1100 West Oak Street, Zionsville, Indiana, on a Petition for Variance of Use, Petition No. 2016-10-UV, filed by counsel, Michael J. Andreoli, on behalf of the Petitioners, William Steven Totty and Tamara Totty, Husband and Wife. Petitioners are seeking a Variance of Use in order to operate an Airbnb on their property. The property is located at 665 West Laurel Avenue, Zionsville, Indiana 46077 and is more particularly described as follows: Part of Lots 1 and 2 and part of vacated Seventh Street between said Lots 1 and 2, all in Laughlin, Fouts and Harden's Addition to the Town of Zionsville in Boone County, Indiana as per plat thereof recorded in Plat Book 3, page 1 in the Office of the Recorder of Boone County, Indiana, more particularly described as follows: From the Southeast corner of Lot 2 of said addition, measure North along the East line thereof 95.00 feet; thence West parallel to the South line of said Lot 2 a distance of 118.00 feet for a place of beginning; thence continuing Westerly on last course described, 160.60 feet across vacated Seventh Street and into said Lot 1; thence deflecting right 90 degrees 46 minutes measure North parallel to the East line of said Lots 1 and 2 (the East lines of said Lots being parallel and each being parallel to vacated Seventh Street), a distance of 72.09 feet to the Southerly or Easterly line of Laurel Avenue (the same being the Northerly or Westerly line of said Lot 1); thence Northeasterly with said line 51.14 feet; thence deflecting right 61 degrees 22 minutes 20 seconds Southeasterly 62.88 feet; thence deflecting left 21 degrees 20 minutes measure Easterly parallel to the South line of said Lot 2 a distance of 63.00 feet; thence deflecting right 90 degrees 46 minutes measure Southerly parallel to the East line of said Lot 2 a distance of 82.00 feet to the place of beginning. Also: A part of Lots 1 and 2 in Laughlin, Fouts and Harden's Addition to the Town of Zionsville in Boone County, Indiana as per plat thereof recorded in Plat Book 3, page 1 in the Office of the Recorder of Boone County, Indiana and a part of Seventh Street in said town heretofore vacated by Decree of the Boone County Circuit Court under Cause No. 23515 and being more particularly described as follows: From the Southwest corner of said Lot 1 measure East along the South line thereof 196.59 feet to a point; thence deflecting left 89 degrees 14 minutes measure Northerly 85.00 feet to a 5/8 inch rebar at the point of beginning of this property; thence continue on same described course 10.00 feet to a 5/8 inch rebar; thence deflecting right 89 degrees 14 minutes measure Easterly 103.60 feet to an iron pin; thence deflecting right 90 degrees 46 minutes 10.00 feet to a 5/8 inch rebar; thence deflecting right 89 degrees 14 minutes measure 103.60 feet to the point of beginning of this description. A copy of the Petition for Variance of Use and all plans pertaining thereto are on file and may be examined prior to the Public Hearing from 8:00 a.m. to 4:00 p.m., Monday through Friday, except for Holidays, in the Office of Planning in the Zionsville Town Hall, 1100 West Oak Street, Zionsville, Indiana 46077. Written comments in support of or in opposition to the Petition for Variance of Use filed with the Secretary of the Zionsville Board of Zoning Appeals prior to the Public Hearing will be considered. The Public Hearing is open to the public and oral comments to the Petition for Variance of Use will be heard at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
