LEGAL ADVERTISEMENT PLAN COMMISSION ANDERSON, INDIANA NOTICE OF PUBLIC HEARING Notice is hereby given that the Plan Commission of the City of Anderson, Indiana, on the 26th day of April, 2016, at 4:30 p.m. (local time) in the City Council Chambers located in City Hall at 120 E. 8th Street, Anderson, Indiana, will hold a public hearing on a proposed vacation of a portion of the Primary Plat for Hickory Estates Addition in accordance with the Subdivision Control Ordinance for the City of Anderson and I.C. ^36-7-4-711.. The lots sought to be vacated are: Lots 1, 2, 3, 4, 5, 7, 8, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39 and 40 in the primary plat of Hickory Estates Addition to the City of Anderson, Indiana. The legal description for the lots to be vacated is described as: A part of the Southeast Quarter of the Northwest Quarter and a part of the Northeast Quarter of the Southwest Quarter of Section 2, Township 19 North, Range 7 East located in Anderson Township, Madison County, Indiana being described as follows: BEGINNING at the southeast corner of the Northwest Quarter of Section 2, Township 19 North, Range 7 East, said point being the southeast corner of Hickory Estates, as recorded in Plat Book 11, Page 14 in the Office of the Recorder of Madison County, Indiana, said point also being on the north line of Van Buskirk Heights Addition, Section Nine as recorded in Plat Book 13, Page 131 in said Office of the Recorder (the plat bearings in said plat being assumed for this description), said point also being the northeast corner of the Southwest Quarter of Section 2, Township 19 North, Range 7 East; thence North 00 degrees 03 minutes 40 seconds West 1140.5 feet along the east line of said Hickory Estates and along the east line of said Northwest Quarter to the northeast corner of said Hickory Estates, said point also being the southeast corner of Greenbriar Park Section 10, as recorded in Plat Book 13, Page 36 in said Office of the Recorder; thence South 89 degrees 24 minutes 20 seconds West 1342.6 feet along the north line of said Hickory Estates and along the south line of said Greenbriar Park Section 10 and the south line of Greenbriar Park Section 4 as recorded in Plat Book 12, Page 72 in said Office of the Recorder to the northwest corner of said Hickory Estates; thence South 00 degrees 34 minutes 20 seconds West 1140.5 feet along the west line of said Hickory Estates and the east line of said Greenbriar Park Section 4, the east line of Greenbriar Park Section 1 as recorded in Plat Book 11, Page 64 in said Office and the east line of the Replat of Greenbriar Park Section 1, Lots 46-53 as recorded in Plat Book 11, Page 78 in said Office of the Recorder to the southeast corner of said Greenbriar Park Section 1, said point also being the northeast corner of Oak Park Addition as recorded in Plat Book 10, Page 67 and the southwest corner of said Northwest Quarter, said point also being the northwest corner of said Southwest Quarter; thence South 00 degrees 00 minutes 20 seconds West 98.6 feet along the west line of said Hickory Estates and the east line of said Oak Park Addition to the northwest corner of Lot Number 12 in said Hickory Estates; thence North 89 degrees 47 minutes 14 seconds East 420.4 feet along the north line of said Lot Number 12, the westerly extension of the north line of Lot Number 9 in said Hickory Estates and the north line of said Lot Number 9 to the northeast corner of said Lot Number 9, said point also being on the east line of said Hickory Estates and the west line of said Van Buskirk Heights Addition, Section Nine; thence North 00 degrees 38 minutes 23 seconds East 101.5 feet along the east line of said Hickory Estates and the west line of said Van Buskirk Heights Addition, Section Nine to the northwest corner of said Van Buskirk Heights Addition, Section 9, said point also being the southwest corner of Lot Number 6 in said Hickory Estates; thence North 00 degrees 38 minutes 23 seconds East 402.6 feet along the west line of said Lot Number 6 to a point on a curve concave to the southeast and having a radius of 300feet; thence northeasterly along said curve and the north line of said Lot Number 6 and arc distance of 115.08 feet (plat) (114.31 feet calculated) to the point of curvature of said curve, subtended by a chord bearing North 82 degrees 29 minutes 30 seconds East 113.62 feet (calculated); thence North 89 degrees 25 minutes 20 seconds East 287.5 feet to the northeast corner of said Lot Number 6; thence South 00 degrees 38 minutes 23 seconds West 416.3 feet along the east line of said Lot Number 6 to the south line of said Hickory Estates and the north line of said Van Buskirk Heights Addition, Section Nine, said point also being on the south line of said Northwest Quarter and the north line of said Southwest Quarter; thence North 89 degrees 25 minutes 20 seconds East 534.0 feet along the south line of said Hickory Estates and the north line of said Van Buskirk Heights, Section Nine and also along the south line of said Northwest Quarter and the north line of said Southwest Quarter to the POINT OF BEGINNING. Containing a total of 32.463 acres, more or less, with 31.497 acres in the Southeast Quarter of said Northwest Quarter and 0.966 acres in the Northeast Quarter of said Southwest Quarter, being subject to all applicable easements and rights-of-way of record. This property is located south of Tamarack Road, east of Raintree Drive and north of Woodview Lane. Written suggestions or objections to the provisions of said proposed vacation may be filed with the City Planning Director at or before such meeting and will be heard by the Plan Commission at the time and place specified. Interested person desiring to present their views, pro or con, upon the proposed vacation, either in writing or verbally, will be given the opportunity to be heard at the above mentioned time and place. This petition may be continued on the Plan Commission agenda from time to time as may be necessary.
