INVITATION TO BID NOTICE is hereby given that sealed bids will be received as follows: BY: DAVIESS COUNTY COMMISSIONERS FOR: DAVIESS COUNTY COURTHOUSE ADA COMPLIANCE PROJECT 200 E. WALNUT STREET WASHINGTON, IN 47501 Bids will be opened and publicly read aloud at: Commissioners Room 200 E. Walnut Street Washington, IN 47501 At the following day and time: March 22nd, 2016 at 9:00 AM Bids may be delivered to the following location prior to the bid date/time: Daviess County Auditor 200 E. Walnut Street Washington, IN 47501 Bids may be delivered immediately prior to 9:00 AM on March 22nd, 2016 in the Commissioners Room. All interested citizens are invited to attend and should any citizens require special provisions, such as handicapped modifications or non-English translation personnel, the County will provide such provisions as long as the request is made by March 15, 2016. Bids received after the date and time set for receipt and opening of bids as herein indicated will be returned unopened. Bids will be received for a single prime contract. Project shall consist of: Modifications of the existing site corner sidewalk intersections and construction of new ADA accessible curb ramps, as well as directional signage, parking signage and other site related ADA accessibility items. Selective demolition of the exterior and interior stairs at the east entrance to the existing courthouse, construction of a new stair and ramp as well as an interior vestibule at location of selective demolition. Mechanical and electrical modifications related to the construction of a new vestibule. Additional ADA compliance work including new drinking fountains, modernization of the existing elevator, signage and toilet room modifications. BIDDERS are encouraged to attend a pre-bid conference with representatives of the Owner and Architect to discuss the project and related requirements. Prebid conference will convene at 11:00 AM local time, on Friday March 11th, 2016 at the Daviess County Courthouse, Commissioners Room, 200 E. Walnut Street, Washington, IN 47501. The work to be performed and the bid to be submitted shall include sufficient and proper sums for all general construction, mechanical installation, labor, materials, permits, licenses, insurance, and so forth incidental to and required for the construction of the facilities. Each bid must be enclosed in a sealed envelope bearing the title of the Project and the name and address of the Bidder. All bids must be submitted on the bid forms as identified in the Contract Documents and Specifications. Bids shall be properly and completely executed on a State Board of Accounts Form 96 (Revised 2010). Each Bid shall be accompanied by the Contractor's Bid Attachment (included with the Contract Specifications) to Form 96, a Financial Statement (completely filled out and signed) and a bid security in the form of an acceptable certified check payable to the Owner or an acceptable Bidder's bond, in an amount of not less than 5% of the total bid price, in accordance with the Contract Specifications. A conditional or qualified bid will not be accepted. Award will be made to the low, responsive, responsible bidder and must not be debarred, suspended, or otherwise be excluded from or ineligible for participation in federally assisted programs under Executive Order 12549. The Owner reserves the right to accept or reject any or all bids and to waive any irregularities in bidding. Base bids may be held for the following period before award of Contract: Sixty (60) Days Should a successful Bidder withdraw his bid or fail to satisfactorily execute all of the requirements and enter into a written Contract within ten (10) days after Notice of Acceptance of his bid, the Owner may declare the Bid Security forfeited, not as a penalty, but as liquidated damages. The successful Bidder shall furnish a Performance Bond and Payment Bond from an approved surety company, which will remain in full force and effect for a period of one (1) year after date of final acceptance of work. Performance Bond and Payment Bond shall be in an amount equal to the following percentage of the Contract Sum: One hundred percent (100%) The construction of the project is funded in part by a grant from the Department of Housing and Urban Development Community Development Block Grant (CDBG) Act, as administered by the Indiana Office of Community and Rural Affairs through its Public Facilities Program. The Contractor to whom the work is awarded shall comply with all requirements of said agency. Neither the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting contract. In accordance with the Davis-Bacon requirements, all contractor and subcontractors are required to pay not less than the Federal prevailing wage rates published by the U.S. Department of Labor for each classification of work performed on this project. Bidders on this work are required to comply with the provisions of the President's Executive Order No. 11246, as amended. The Bidders shall also comply with the requirements of 41 CFR Part 60-4 entitled "Construction Contractors Affirmative Action Requirements". Section 3 of the Housing and Urban Development Act of 1968 provides that to the greatest extent feasible, training and employment opportunities shall be made available to lower-income residents of project areas and that contracts be awarded to small businesses located within the project area or owned in substantial part by project area residents. The Bidder's attention is also called to the "Minority/Women Business Participation" requirements. The Office of Community and Rural Affairs has adopted a State goal of 10% participation for minority and female-owned businesses for construction-related or purchase-related contracts for the work. The Contractor must meet guidelines and practices established by the Indiana Office of Community and Rural Affairs and appropriate Federal regulations including: 1) Executive Order 11246; 2) Section 3 of the Housing and Community Development Act of 1968 as amended; 3) Certification of Non-Segregated Facilities; 4) OMB Circular A-102; 5) Title VI of the Civil Rights Act of 1964; 6) Section 504, Rehabilitation Act of 1973; 7) Age Discrimination Act of 1975; 8) Executive Order 12138; 9) Conflict of Interest Clause; 10) Retention and Custodial Requirements for Records Clause; 11) Contractors and Subcontractors Certifications; and others that may be appropriate or necessary. In addition, the Contract Division procurement is subject to the Federal Regulations contained in the OMB Circular A-102, Sections B and O and the State of Indiana requirements contained in Indiana Code 36-1-9 and Indiana Code 36-1-12.
