ORDINANCE NO. 2016-6 AN ORDINANCE SUPPLEMENTING ORDINANCE 1986-10 AN ORDINANCE REGULATING THE CONNECTION TO AND USE OF PUBLIC AND PRIVATE SEWERS AND DRAINS, THE INSTALLATION AND CONNECTION OF BUILDING SEWERS, AND THE DISCHARGE OF WATERS AND WASTES INTO THE PUBLIC SEWER SYSTEM OF THE TOWN OF WESTPORT, INDIANA WHEREAS, the Town Council of the Town of Westport, Indiana, finds that the existing ordinances of the Westport Municipal Code should be supplemented hereto, and WHEREAS, the Indiana Department of Environmental Management (IDEM), on or about March 2016, has given the Town of Westport a Sewer Ban Early Warning notice, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTPORT, INDIANA, that: Ordinance 1986-10 of the Town of Westport Code of Municipal Ordinances, is hereby supplemented with the following Sections under this Ordinance. Section 16 (d) INSPECTION OF CONNECTIONS / DISCONNECTIONS (1) Except as hereinafter provided, upon the change in ownership (be it by deed or recorded contract) of every residential lot, parcel of real estate, or building that discharges sanitary waste into the sanitary sewer system of the Town of Westport, said property shall be inspected for proper sanitary sewer connections, inflow and infiltration. No water service shall be provided to such property until a satisfactory CERTIFICATE OF INSPECTION has been issued by the Superintendent of the Westport Water & Sewer Utility. The fee for the issuance of a satisfactory CERTIFICATE OF INSPECTION shall be $20.00, which sum shall be paid to the Clerk's Office by the then owner of the property inspected. (2) The inspection required hereunder shall be at the Town's cost and may include, but not limited to, televising and recording the condition of the sewer lateral leading from the premises to the City's sewer main; conducting smoke testing, and liquid dye testing; and entrance onto the property to verify that no sump pump, foundation drains, downspouts, or other prohibitive connections are connected to the sanitary sewer system. (3) No water service shall be provided to such premises until such time as any defects or improper connections found by such inspection have been corrected at the owner's expense, and to the satisfaction of the Superintendent of the Westport Water & Sewer Utility, or his designee. (4) Once inspected, any such property receiving a satisfactory CERTIFICATE OF INSPECTION shall not be subject to re-inspection under this section for a period of 5 years unless there is evidence that a violation has occurred since the last inspection.
