NOTICE TO BIDDERS - SECTION 001113 Notice is hereby given that sealed bids will be received: BY Board of Commissioners of Rush County 101 East 2nd Street, Courthouse Rushville, IN 46072 FOR Rush County Sheriff's Office and Jail AT Rush County Auditor 101 East 2nd Street, Room 212 Rushville, IN 46173 UNTIL 2:00 PM local time, December 20, 2016 Bids received after that time will be returned unopened. OPENING The sealed bids will be publicly opened and read aloud at 2:30 PM in Assembly Room #106 in the Rush County Courthouse located at 101 East 2nd Street, Rushville, IN 46173. All work for the complete construction of the project will be under multiple prime contracts with the Owner or its assignee based on bids received and on combinations awarded. The Construction Manager will manage the construction of the project. Once registered, bidders will be able to review documents online and order printed copies of plans and specifications. Printed documents can be picked up from Eastern Engineering Supply or they can be shipped directly to you. Bidders are required to pay all printing, shipping, handling, and online fees. The bid documents can be viewed at http://distribution.easternengineering.com. All bidding contractors that receive documents from this site will receive project update notifications throughout the bid process. Questions about the online access or the availability of printed documents can be directed to Eastern Engineering at 260/426-3119. Bid security in the amount of five percent (5%) of the bid must accompany each bid in accordance with the Instructions to Bidders. Bid security shall be a certified check or bid bond and shall be the bidder's guarantee that said bidder will, if the contract is awarded to said bidder, execute within ten (10) days of acceptance of his bid, a Contract for the work bid upon. All bid bonds shall be made payable to the Board of Commissioners of the County of Rush and be executed by a surety company authorized to do business in the State of Indiana. Board of Commissioners of the County of Rush reserves the right to assign any portion of the bid or bids to the Holding Corporation. The Owner reserves the right to accept or reject any bid (or combination of bids) and to waive any irregularities in bidding. No bidder may withdraw his bid for a period of sixty (60) calendar days after the date set for bid opening. An out-of-state contractor will have Indiana State Gross Income Tax withheld by the Owner, unless they can show proof that they are registered with the Indiana Secretary of State to conduct business in the State of Indiana. The successful bidders will be required to furnish Performance and Payment Bonds for one hundred percent (100%) of their contract amount prior to execution of contracts. Bonds shall be maintained in accordance with IC. 36 1 12 13.1 and 36 1 12 14. Bonds shall be in full force and effect for a period of at least 12 months after the date of final completion and acceptance of the longest guarantee provided under the contractor's contract. Should the contractor's bonding company default; the contractor will be responsible for securing a new bond within fourteen (14) calendar days. All Contracts awarded shall be conditional upon, and subject to, the completion of financing by the Holding Corporation of bonds in an amount sufficient to cover the cost of construction, plus all incidental expenses. Awarded contracts will also be subject to termination, without penalty or liability, at the option of the Holding Corporation at any time after the date of execution in the event the Corporation shall determine that financing in the required amount cannot be completed. In the event financing is not complete within the time allotted for base bids plus alternate time extensions after the bid date, any contractor may withdraw his bid, without liability, by written notice. Such cancellation shall be effective ten (10) days after written notice. All Contracts are assignable in whole or in part as between the County and the Holding Corporation without consent. All Contractors shall be required to provide separate Performance and Payment Bonds for their respective contracts. Bid proposals shall be complete and properly executed on the bid form provided. Each bid proposal shall include a Non Collusion Affidavit and State Board of Accounts Form 96, as required by the statutes of Indiana. It is the intention of the Owner that construction of the project will start March 2017, contingent on financing, and all work will be complete November 2018. If there are any conflicts between the contractual documents and the laws of the federal government, or the State of Indiana, the laws shall be deemed to control. Bidders are urged to attend a pre-bid conference at 10:00 AM local time, December 6, 2016 in Assembly Room #106 in the Rush County Courthouse located at 101 East 2nd Street, Rushville, IN 46173. Representatives of the Owner, Architect and Construction Manager will be present to discuss construction sequence, bidding requirements and information, contractor's work and storage areas and requirements for contractor's personnel.
