NOTICE OF PUBLIC HEARING BY THE TOWN OF BROWNSBURG BOARD OF ZONING APPEALS Notice is hereby given, pursuant to I.C. 5-3-1-2, that the Town of Brownsburg Board of Zoning Appeals (the Board) will conduct a public hearing regarding an application for Case No. BZDV-11-16-1465, a Development Standards Variance from Article 5, ^5.30 (A)(2) as it relates to Article: 2, ^2.38 Maximum Floor Area of the Town of Brownsburg Zoning Ordinance. The application was filed by Brownsburg Partners, LLC (the Applicant) to: Allow an increase in the Maximum Floor Area in the Low Intensity Industrial (I1) District. The real estate subject to this application is generally described as follows: A part of the Northwest Quarter of Section 12, Township 16 North, Range 1 East, Hendricks County, Indiana, more particularly described as follows: Commencing at the Northwest corner of the Northwest Quarter of said Section 12; thence South 00 degrees 02 minutes 22 seconds West (assumed bearing) along the West line of the said Northwest Quarter 73.67 feet to the Southern line of a 0.003 acre tract described in Instrument No. 201306231 in the Office of the Recorder of Hendricks County, Indiana; thence North 74 degrees 56 minutes 19 seconds East along said Southern line 31.77 feet to the South line of Instrument No. 200500037412 as recorded in the said Recorder's Office; thence South 89 degrees 13 minutes 42 seconds East along the South line of said Instrument 623.01 feet to the Northeast corner of a 10.451 acre tract conveyed to Estes Northwest Realty, LLC (Estes tract) and the Point of Beginning; thence continuing South 89 degrees 13 minutes 42 seconds East along the said South line 1233.85 feet; thence South 81 degrees 55 minutes 22 seconds East along the said South line 62.22 feet to the West line of Lot 3 in Eaglepoint Business Park, as per Secondary Replat thereof, Recorded in Plat Cabinet 6, Slide 63 as Instrument No. 200500018809 in the said Recorder's Office; thence South 00 degrees 02 minutes 22 seconds West along the said West line 875.53 feet to the Southwest corner thereof; thence continuing South 00 degrees 02 minutes 22 seconds West along the right of way line of Eastpoint Circle per the Secondary Plat for Lot 3 in Eaglepoint Business Park, recorded in Plat Cabinet 5, Slide 100 as Instrument No. 200300042184 in the said Recorder's Office 116.71 feet; thence South 89 degrees 16 minutes 52 seconds East along the right of way line of Eastpoint Circle 6.74 feet; thence South 00 degrees 16 minutes 28 seconds West along the Western right of way line of Eastpoint Circle per the Replat of Lot 4 in Eaglepoint Business Park recorded in Plat Cabinet 5, Slide 99 as Instrument No. 200300042106 in the said Recorder's Office 64.39 feet; thence South 32 degrees 16 minutes 38 seconds West along the said Western right of way line of Eastpoint Circle 608.85 feet to the North line of a 0.006 acre tract described in Instrument No. 201306231 in the said Recorder's Office; thence South 82 degrees 05 minutes 56 seconds West along said Northern line 22.43 feet to a point on a non-tangent curve to the right having a radius of 757.50 feet, the radius point of which bears South 25 degrees 15 minutes 43 seconds West; thence Westerly along said curve 321.53 feet to a point which bears North 00 degrees 56 minutes 31 seconds East from said radius point; thence North 89 degrees 03 minutes 29 seconds West 488.28 feet; thence North 00 degrees 46 minutes 18 seconds East 936.33 feet; thence North 89 degrees 13 minutes 42 seconds West 392.35 feet to a point on the Eastern line of the aforesaid Estes tract (the next 5 courses are along the Eastern boundary of the said Estes tract); 1) thence North 00 degrees 46 minutes 18 seconds East 275.00 feet; 2) thence South 89 degrees 13 minutes 42 seconds East 147.80 feet to a non-tangent curve to the right having a radius of 40.00 feet, the radius point of which bears South 42 degrees 10 minutes 53 seconds West; 3) thence Southeasterly along said curve 13.09 feet to a point which bears North 60 degrees 55 minutes 53 seconds East from said radius point, said point lies on a reverse curve having a radius of 70.50 feet, the radius point of which bears North 60 degrees 55 minutes 53 seconds East; 4) thence Southeasterly along said curve 74.02 feet to a point which bears South 00 degrees 46 minutes 18 seconds West from said radius point; 5) thence North 00 degrees 46 minutes 18 seconds East 351.52 feet to the Point of Beginning, containing 41.862 acres, more or less. The public hearing will be held at 7:00 p.m. on the 12th day of December, 2016 at the Town Hall, Council Meeting Room, 61 N. Green Street, Brownsburg, Indiana 46112 where all interested parties will be given an opportunity to testify regarding the proposal. The application and file on this matter is available for examination at the Department of Development Services, between the hours of 8:00 A.M. to 4:00 P.M., Monday through Friday, exclusive of legal holidays, at the above address.
