NOTICE OF ORDINANCE ADOPTION Notice is hereby given that the Carthage Town Council, pursuant to Indiana Code ^ 36-5-2, et seq., passed and adopted the following Ordinance at a public meeting held on March 14, 2016, that prohibits parking in excess of seventy-two continuous hours within the Town of Carthage, Indiana. The Ordinance follows. A copy of the Ordinance is also available for review in the office of the Town Clerk-Treasurer, 6 West First Street, Carthage, IN. TOWN OF CARTHAGE, INDIANA ORDINANCE 1 - 2016 WHEREAS, The Town Council of the Town of Carthage, Indiana, (hereinafter referred to from time to time as "Town") has recognized the need to regulate the duration of continuous parking within the Town of Carthage, Indiana; and WHEREAS, the Town desires to prohibit parking in excess of seventy-two (72) continuous hours so that Town employees can have better and more frequent access to the streets and alleys of the Town for debris removal, maintenance, and other matters. WHEREAS, the Town Council desires to amend a particular section of Chapter 72 (Parking Schedules) of Title VII (Traffic Code) of the Town Code, by adding a subparagraph (D) to said section; NOW THEREFORE, BE IT ORDAINED by the Town Council of the Town of Carthage, Rush County, Indiana: Section 1: That Chapter 72 (Parking Schedules) of Title VII (Traffic Code) of the Town Code of Carthage, Indiana, is hereby modified and amended by adding the language below as a new subparagraph (D) to the same: (D) No vehicle, with or without motive power, including but not limited to mobile campers, boats, motorcycles, mopeds, trailers, wagons, or any vehicle designed for the conveyance of persons, property, or animals, shall be parked on a Town street, alley, or right of way for more than 72 continuous hours. Vehicles must be moved a minimum of 500 feet before being returned. An enforcement officer shall, in a prominent place, tag vehicles in violation of this ordinance. This tag shall include the date and time of the tagging and the tagging officer's badge number. This will serve as notification that the vehicle is considered abandoned and must be moved within 72 hours. If a vehicle is not moved pursuant to the tag, the owner of the vehicle shall be fined $25.00 and shall also be responsible for the cost of towing and impounding the vehicle. Section 2: This Ordinance shall repeal prior ordinances to the extent said prior ordinances are in conflict herewith, and the remaining portions of said ordinances shall remain in full force and effect. Section 3: This Ordinance shall be in full force and effect from and after its passage and adoption, and proper publication required by law, whichever is later. All of which is PASSED, ADOPTED, AND ORDAINED by the Town Council of the Town of Carthage, Indiana, on this 14th day of March, 2016. RR-108 3/29 hspaxlp #1171586
