NOTICE OF ADOPTION OF AMENDATORY RESOLUTIONS BY ELKHART COUNTY REDEVELOPMENT COMMISSION AMENDING ECONOMIC DEVELOPMENT AREA KNOWN AS THE NORTHEAST CORRIDOR TIF DISTRICT TO: Citizens of Elkhart County, Indiana Property Owners in Amended Economic Development Area All Other Interested Parties NOTICE IS HEREBY GIVEN that the Elkhart County Redevelopment Commission adopted Resolution No. 2015-13 on December 3, 2015 and Resolution No. 2016-02 on February 4, 2016 amending the economic development area for the Northeast Corridor TIF District and hereinafter referred to as the Amendatory Resolutions which add certain real estate in Elkhart County, Indiana to the Northeast Corridor TIF District more particularly described as follows: A part of Section 28, Township 38 North, Range 5 East and Section 33, Township 38 North, Range 5 East in Osolo Township, Elkhart County, Indiana, more particularly described as follows: Commencing at the Northwest corner of the Southwest Quarter of said Section 28, Township 38 North, Range 5 East; thence Southwardly along the West line of said Section, 670.7 feet to the point of beginning; thence North 89 degrees 25 minutes East parallel with the South line of said half of said Quarter Section 1046.4 feet; thence due North parallel with the West line of said Quarter Section 300 feet; thence continuing North 89 degrees 25 minutes East parallel with the South line of said Quarter Section 290.4 feet; thence due South parallel with the West line of said Quarter Section 600 feet to the North line of Miner Road; thence East along the North line of Miner Road to the East end of said Miner Road as dedicated in Deed Record 290, page 661; thence South parallel with the West line of said Quarter Section and along the West line of land conveyed to Indiana & Michigan Electric Company land (Deed Record 214, page 349) to the North line of North Park Subdivision as recorded in Plat Book 2, page 110; ALSO INCLUDING all public right-of-way located within or adjacent to the above-described real estate. FURTHER LESS AND EXCEPTING: LOTS NUMBERED FIFTEEN (15), SIXTEEN (16) AND TWENTY-THREE (23) AS THE SAID LOTS ARE KNOWN AND DESIGNATED ON THE RECORDED PLAT OF ROSE LAWN SUBDIVISION, IN OSOLO TOWNSHIP, ELKHART COUNTY, INDIANA; SAID PLAT BEING RECORDED IN PLAT BOOK 2, PAGE 79 THRU 81 OF THE RECORDS OF THE RECORDER OF ELKHART COUNTY, INDIANA. The Elkhart County Plan Commission on February 11, 2016 adopted a Written Order consistent with Indiana Code ^36-7-14-16 approving the Amendatory Resolutions, Economic Development Plan, Factual Report, and attachments thereto for the Amended Northeast Corridor TIF District. The Board of Commissioners of the County of Elkhart, Indiana issued the Written Order pursuant to Indiana Code ^36-7-14-16 on the 7th day of March, 2016 approving the Amended Northeast Corridor TIF District as contemplated by said Amendatory Resolutions. The Amendatory Resolutions include an Economic Development Plan for the Amended Northeast Corridor TIF District and a Factual Report in Support of Findings as contained in Resolution Number 2015-13. Generally stated, the Amendatory Resolutions, Economic Development Plan, and Factual Report have defined the Amended Northeast Corridor TIF District to be benefited by the proposed Economic Development Plan for the development thereof, which development and plan will be of public utility and benefit, and which plan and development cannot be achieved by regulatory processes or by the ordinary operation of private enterprise without resort to the powers and authorities allowed the Elkhart County Redevelopment Commission under Indiana Code ^36-7-14 et seq. Generally stated, the public improvements contemplated for the Amended Northeast Corridor TIF District include, but are not limited to, the improvement, extension, and construction of water lines, sewer lines, and public roads in the Amended Northeast Corridor TIF District; the improvement of public rights-of-way; and the acquisition and demolition of run-down, dilapidated, and blighted real estate structures in the Amended Northeast Corridor TIF District, all as more particularly described within the Amendatory Resolutions, Economic Development Plan, and Factual Report. The Amendatory Resolutions include a provision establishing an allocation provision under Indiana Code ^36-7-14-39. Maps and plats have been prepared pertaining to the Amendatory Resolutions and the Amended Northeast Corridor TIF District, which can be inspected at the Elkhart County Department of Public Services, Department of Planning, 4230 Elkhart Road, Goshen, Indiana 46526. The Elkhart County Redevelopment Commission will receive and hear remonstrances and objections from persons interested in or affected by the proceedings pertaining to the proposed project, Amendatory Resolutions, and Economic Development Plan, and will determine the public utility and benefit of the proposed project, Amendatory Resolutions, and Economic Development Plan. The public hearing to be conducted by the Elkhart County Redevelopment Commission, at which time it will receive and hear remonstrances and objections, and address the public utility and benefit of the proposed project, shall be on April 7, 2016 at 2:00 P.M. at the Elkhart County Department of Public Services, Meeting Room "A," 4230 Elkhart Road, Goshen, Indiana 46526. A copy of this Notice of Hearing shall be filed in the Office of the Elkhart County Plan Commission, Elkhart County Board of Zoning Appeals, Elkhart County Department of Planning and Development, Elkhart County Building Department, Elkhart County Building Commissioner, Elkhart County Highway Department, Elkhart County Health Department, Elkhart County Park Department, and Elkhart County Surveyor's Office pursuant to Indiana Code ^36-7-14-17.
