STATE OF INDIANA SS: COUNTY OF MADISON OFFICE OF THE BUILDING COMMSSSIONER TOWN OF EDGEWOOD, INDIANA LEGAL NOTICE TO OWNER(S) OF APPROVED ORDER TO DEMOLISH AND REMOVE TO: Wiper Corporation, Inc. AND OR Mr. Joseph Fakhr FOR THE PROPERTY LOCATED AT: 215 Tower Road, Anderson, IN 46011 LEGAL DESCRIPTION: Lot Numbered 104 in the original plat of the Town of Edgewood, Madison County, Indiana, the plat of which is recorded in Plat Book 8, Page 14, in the Office of the Recorder of Madison County, Indiana BUILDING DESCRIPTION: Single Story Single Family House and Detached Garage The Order to Demolish and Remove the unsafe house, detached garage and remediate the un-kept landscaping on the property known as 215 Tower Road was issued on July 18th, 2016. On May 11th, 2012 and on June 20th, 2016 inspections were conducted of the house, garage and property. Your house, garage and the property are unsafe and unviable per State Statute I.C. 36-7-9-1 et seq. and City Ordinance 12-23-1992A. This Order was heard by the Town Board of Edgewood Indiana at a hearing dated August 15th, 2016 and confirmed. The first publication of this notice was to inform all interested parties that the Order, as issued by Julie Armington, Building Commissioner, and was heard by the Town Board. The Town Board indeed approved the order and then continued the matter to another meeting because Wiper Corporation had transferred the property to Joseph Fakhr on August 10th, 2016. Mr. Fakhr appealed to the Board to remove the Demolition Order. Mr. Fakhr was given 30 days to provide a written work plan and budget of how the house and garage at 215 Tower would be completely repaired, remodeled and restored to viable, livable condition. Mr. Fakhr was also to provide references and proof of financial ability to conduct the work. A second hearing was conducted at 5:00 PM upon September 19th, 2016, in the Chambers of the Town Board, Edgewood Town Hall, at 3405 Nichol Avenue, Anderson, Indiana 46011 to remove the continued Demolition Order. Mr. Fakhr had failed to provide neither the Building Commissioner or the Town Board with any of the required documents. Mr. Fakhr appealed to the Town Board again. The Town Board voted to allow Mr. Fakhr ten (10) business days in which to provide the required documents to the Building Commissioner. A third hearing was conducted at 5:00 PM upon October 17th, 2016, in the Chambers of the Town Board, Edgewood Town Hall, at 3405 Nichol Avenue, Anderson, Indiana 46011 to remove the continued Demolition Order. Mr. Fakhr failed to show at this meeting. Mr. Fakhr also failed to comply with submitting the required documents to the Building Commissioner and or the Town Board in order for the Board to consider removing the Demolition Order. The Town Board voted to amend the original Demolition Order to include issuance to him, Mr. Joseph Fakhr. The Town Board also voted approval of the Record Hearing Determination giving Mr. Fakhr thirty (30) days in which to Demolish and Remove the house and garage located at 215 Tower Road. Indiana Statue I.C. 36-7-9-1 et seq. permits the Town of Edgewood to hire a contractor to demolish and remove the houses and remediate the un-kept landscape AT Mr. Fakhr's EXPENSE. State Statute also allows the Building Commissioner's office to invoice for All Costs plus an average processing expense to cover administrative expenses.
