Pierce; MainSource Bank - Rushville Downtown; and Collection Associates, LLC Defendants CASE NO. 70D01-1608-MF-000287 NOTICE OF SUIT To the defendants named below herein, and any other person who may be concerned. You are notified that you have been sued in the Court named above. The nature of the suit is the foreclosure of a mortgage upon the property located in Rush County at 1116 Waggoner Dr., Rushville, IN, 46173, legally described as: Lot number Twenty-one (21) and Lot number Twenty-Two (22) in Parkview Addition, Second Section, Rushville, Indiana, as recorded in Plat Book 3, page 47, in the Office of the Recorder of Rush County, Indiana. EXCEPTING, Part of Lot No. 22 in Parkview Addition, Second Section, Rushville, Indiana described as follows: Beginning at a point in the West line of said Lot No. 22 that is Northwesterly 32.50 feet arc distance along said West line from the Southwest corner of said Lot No. 22; thence North 57 degrees 38 minutes East 115.99 feet to the Easterly line of said Lot No. 22; thence North 31 degrees 17 minutes West 32.50 feet to the Northeast corner of said Lot No. 22; thence South 57 degrees 16 minutes West 123.78 feet along the Northerly line of said Lot to the Northwest corner of said Lot No. 22; thence Southeasterly 21.41 feet arc distance along the West line of said Lot No. 22 to a point of reverse curvature; thence Southeasterly 11.09 feet arc distance along said West line to the point of beginning. (hereafter Real Estate). This summons by publication is specifically directed to the following defendants who may claim some interest in the Real Estate and whose whereabouts are not known with certainty: Douglas Ray Pierce and Shawna S. Pierce You must respond to this summons by publication, by you or your attorney, on or before thirty (30) days after the Third Notice of Suit has been published. If you fail to do so, a default judgment may be entered against you for the relief demanded in the Complaint. You may be entitled to a settlement conference that will allow you to speak with your mortgage company and discuss alternatives to foreclosure.
