IN THE CIRCUIT COURT OF FLOYD COUNTY STATE OF INDIANA CASE NO. 22C01-1609-GU-00083 IN THE MATTER OF THE GUARDIANSHIP OF JAMES KAESTNER, SR., an incapacitated adult NOTICE OF FILING PETITION FOR APPOINTMENT OF GUARDIAN On September 20, 2016, in the Floyd Circuit Court, a Petition for Appointment of Marilinda Wheatley as Guardian of the person and estate of James Kaestner, Sr. was filed to determine whether a guardian should be appointed for James Kaestner, Sr. The purpose of this proceeding is to protect James Kaestner, Sr. The Court will determine whether James Kaestner, Sr. is an incapacitated person or minor under Indiana law. If the Court finds that James Kaestner, Sr. is an incapacitated person or minor, the Court shall also consider whether Marilinda Wheatley should be appointed as Guardian of James Kaestner, Sr. The Court may, in its discretion, appoint some other qualified person as guardian. The Court may also, in its discretion, limit the powers and duties of the guardian to allow James Kaestner, Sr. to retain control over certain property and activities.
