STATE OF INDIANA IN THE MARION SUPERIOR COURT SS: COUNTY OF MARION CAUSE NO. 49D13 1512 PL 041911 IN RE: ESCHEATMENT OF MATURED, UNREDEEMED AND UNCLAIMED UNITED STATES SAVINGS BONDS WITH PURCHASERS OR OWNERS WITH LAST KNOWN ADDRESSES IN THE STATE OF INDIANA ATTENTION AND NOTICE OF SUIT REGARDING MATURED U.S. SAVINGS BONDS To the list below of owners of United States savings bonds currently in the possession of the Indiana Attorney General's Unclaimed Property Division and being held as unclaimed property pursuant to Indiana law; and, to the class of unknown owners of United States savings bonds that have also reached their final maturity date and have not been redeemed, that have been lost, stolen, destroyed, abandoned or relinquished by the owner, have owners with a last known address in the State of Indiana according to the records of the U.S. Treasury Department, and that were issued during the following timeframes: a. 40-year Series E bonds issued between 1941 and November 30, 1965; b. 30-year Series E bonds issued between December 1965 and June 30, 1980; c. Series EE bonds issued between January, 1980 and July 1, 1982; d. Series A, B, C, D, F, G, J and K bonds (all of which were issued prior to 1958); e. Series H bonds issued on or before December 31, 1979; f. Series HH bonds issued between January, 1980 and July 1, 1992; and to all other concerned persons, You are notified that such property has been presumed to be abandoned. You are further notified that a petition pursuant to the Indiana Unclaimed Property Act, Ind. Code ^ 32-34-1 et seq., and identifying you as an owner has been filed in the Marion Superior Court by the Indiana Attorney General's Unclaimed Property division, 200 W. Washington St. Indianapolis, IN 46204, seeking a declaration that title to the above-described U.S. savings bonds has passed to the state of Indiana way of escheat pursuant to Ind. Code ^ 32-34-1-20.5. There are hundreds of millions of dollars in matured U.S. Savings Bonds which were issued to Indiana citizens decades ago, most of which have become abandoned, lost, stolen, destroyed or relinquished. The U.S. Treasury owes billions of dollars for mature bonds which have gone unclaimed for decades, but the U.S. Treasury continues to hold the proceeds of these bonds while making little to no effort to seek out the owners and return the proceeds. Millions of mature bonds remain unclaimed for years and are never redeemed with the U.S. Treasury holding this money in perpetuity for its own use. To address this inequity, the Indiana legislature passed legislation to allow the State of Indiana to take title to unclaimed and abandoned U.S. Savings Bonds by a process known as title-based escheatment. The new law also provides persons asserting an equitable interest in the proceeds from these bonds to assert a claim for payment of these proceeds after redemption by the state occurs. The Office of the Indiana Attorney General is taking steps to recover the proceeds from these abandoned, lost, stolen, destroyed, relinquished, and unclaimed mature U.S. Savings Bonds. If, however, you have a mature and unredeemed U.S. Savings Bond described in this notice and need assistance in redeeming this bond or desire to keep legal title to such bond, please contact the number at the bottom of this notice for additional information and assistance. You are hereby required to answer the petition or other pleading or otherwise respond to the Marion Superior Court no later than 30 days after March 16, 2016 which is the last date this Notice will be published. If you fail to answer or otherwise defend, the petition or other pleading will be taken as true, and judgment, the nature of which will be stated and may include a declaration that title to the above-described U.S. savings bonds have passed to the state of Indiana by way of escheat, will be rendered accordingly.
