NOTICE TO CITIZENS AND PROPERTY OWNERS OF FINDINGS AND ORDER OF THE ELKHART COUNTY DRAINAGE BOARD RE: BERLINCOURT LATERAL A TILE REPLACEMENT PROJECT (16-026) Notice is hereby given that the Elkhart County Drainage Board, at a legally conducted public hearing held on September 6, 2016, formally approved the plans and specifications for the Berlincourt Lateral A Tile Replacement Project in Locke Township, Elkhart County, Indiana. At said hearing, the Board adopted the plans and Tile Replacement Report of the Elkhart County Surveyor, after determining the costs, damages, and expenses of the proposed improvement will be less than the benefits which will result to the owners of land benefitted thereby. Additionally, as part of its adoption of the Report of the Surveyor, the Board determined that the entire Project should be funded by Cumulative Drainage Funds, and thus no landowners will be assessed directly for the costs of the Project. Finally, the Board issued an order declaring the proposed improvements as shown by the report of the Surveyor, and the plans and specifications for said Project, to be established. The Findings and Order of the Elkhart County Drainage Board have been filed, and are available for inspection in the office of the Elkhart County Surveyor, 4230 Elkhart Road, Goshen, Indiana 46526. Should one affected by said Findings and Order of the Elkhart County Drainage Board desire judicial review thereof, he or she must proceed pursuant to Indiana law within twenty (20) days from the date of publication of this Notice or said Findings and Order shall, pursuant to Indiana Code Section 36-9-27-106, become conclusive ELKHART COUNTY DRAINAGE BOARD By: Lynn Loucks, President September 13 hspaxlp
