SUMMONS BY PUBLICATION CAUSE NO. 20D03-1608-PL-215 IN ELKHART SUPERIOR COURT NO. 3 FOR THE STATE OF INDIANA, COUNTY OF ELKHART, SS: City of Goshen, Indiana; Petitioner, v. Elders of Goshen Baptist Church Cemetery, and its Unknown Successors and Assigns; Respondent This Summons is to the Respondent, Elders of Goshen Baptist Church Cemetery and its Unknown Successors and Assigns, and to any other person who may be concerned. You are notified that you have been sued in the Elkhart Superior Court No. 3, 101 North Main Street, Goshen, Indiana 46526, 574-535-6440, in an action entitled City of Goshen, Indiana v. Elders of Goshen Baptist Church Cemetery and its Unknown Successors and Assigns, Cause No. 20D03-1608-PL-215, by the person named above as Petitioner. The named Petitioner is represented by Donald R. The nature of this suit is a quote title action for a certain parcel of real estate located at the West Goshen Cemetery, and more fully described below in this Summons. An answer or other response in writing to the complaint must be filed either by you or your attorney on or before October 3, 2016, and if you fail to do so, judgment by default may be rendered against you for the relief demanded by the Petitioner. If you deny the request and/or have a claim for relief against the Petitioner arising from the same transaction or occurrence, you must assert it in your written answer. It is suggested that you consult with an attorney of your choice regarding this matter. Pursuant to I.C. ^ 32-30-3-14, you are on notice that this action is one to quiet title to piece of real estate located in Elkhart County, Indiana. Pursuant to I.C. ^ 32-30-3-14, you are on notice that the subject real estate has the following legal description: The following real estate located in Elkhart County, in the State of Indiana, to-wit: 57/100 of an acre in the East Half of the Northeast Quarter of Section Seventeen (17) Township Thirty-six (36) North, Range Six (6)East, Elkhart Township, more particularly described as follows: Beginning at a stone (the southeast corner of a tract of land sold to said Grantees and recorded in Record No. 26, page 104) that is Four and 50/100 chains East and Twenty Three and 84/100 chains South, of the stone at the Southwest corner of the tract of land above referred to; thence East One Hundred and Fifty-seven (157) feet; thence North One Hundred and Fifty-nine (159) feet; thence West One Hundred and Fifty-seven (157) feet; thence South One Hundred Fifty-nine (159) feet to the Place of Beginning. AND The following real estate located in Elkhart County, in the State of Indiana, to-wit: Commencing at a stone Nineteen (19) chains and Thirty-four (34) links South of the Southwest corner of a lot of land deeded to the Elders of the German Baptist Church and running thence East Four (4) chains and Fifty (50) links to a stone Forty (40) inches in diameter. North Thirty-nine (39) degrees East Twenty-eight (28) links; South Four (4) chains and Fifty (50) links; thence West Four (4) chains and Fifty (50) links to a stone; thence North Four (4) chains and Fifty (50) links to the place of beginning, being in the East Half of the Northeast Quarter of Section Seventeen, Township Thirty-six (36) North of Range Six (6) East.
