Wood has breached the terms of both a Retail Installment Contract and Mortgage entered by and among Melinda S. Wood and the plaintiff on or about July 24, 2002 wherein she promised but failed to make repayment of a real estate note secured by the following property owned by her: Lot Number Two (2) in Vashti David Third (3rd) Addition to the Town of Walton, Cass County, Indiana as recorded in recorder's Plat 3, Page 47 in the Office of the Recorder of Cass County, IN Commonly known as: 605 East Duchess Street, Walton, IN 46994 This Summons by publication is specifically directed to the following named defendant whose address and whereabouts is unknown: Estate and Heirs of Melinda S. Wood. If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer. You must answer the Complaint in writing, by you or your attorney, on or before the thirtieth day after the third notice of suit published in this newspaper.
