FOR THE PROPERTY LOCATED AT: 215 Tower Road, Anderson, IN 46011 LEGAL DESCRIPTION: Lot Numbered 104 in the original plat of the Town of Edgewood, Madison County, Indiana, the plat of which is recorded in Plat Book 8, Page 14, in the Office of the Recorder of Madison County, Indiana BUILDING DESCRIPTION: Single Story Single Family House and Detached Garage The Order to Demolish and Remove the unsafe house, detached garage and remediate the un-kept landscaping on the property known as 215 Tower Road. This Order will be heard by the Town Board of Edgewood Indiana at a hearing dated August 15th, 2016. This notice is to inform all interested parties that the Order, as issued by Julie Armington, Building Commissioner, will be heard by the Town Board. The Town Board can approve, modify or rescind the order or continue the matter to another meeting date and time. A hearing will be conducted at 5:00 PM upon August 15th, 2016, in the Chambers of the Town Board, Edgewood Town Hall, at 3405 Nichol Avenue, Anderson, Indiana 46011. You and any representative(s) and or your attorney will be permitted to appear at the hearing. You may present evidence of any kind for the Town Board's consideration. Indiana Statue I.C. 36-7-9-1 et seq. permits the Town of Edgewood to hire a contractor to demolish and remove the houses and remediate the un-kept landscape AT YOUR EXPENSE. On May 11th, 2012 and on June 20th, 2016 inspections were conducted of the house, garage and property. Your house, garage and the property are unsafe and unviable per State Statute I.C. 36-7-9-1 et seq. and City Ordinance 12-23-1992A. State Statute also allows the Building Commissioner's office to invoice for All Costs plus an average processing expense to cover administrative expenses. If the invoiced amount indicated is not paid after thirty (30) days have elapsed after the date of the invoice for completion of the work, the Town of Edgewood may either take court action against all persons having an interest or life estate interest in the Unsafe Premises; or, the Town of Edgewood can certify to the County Auditor the amount owed, including any incurred interest, to be collected on the tax duplicate as a special assessment in the same manner as delinquent taxes are collected as provisions provide in Indiana Statute IC 36-7-9-13 or 13.5 If owners of interest do not attend, a Decision by the Town Board can be made in your absence. Owners of Interest may call the Office of the Building Commissioner between 8:00 a.m. through 4:00 p.m., Monday through Thursday, to possibly make arrangements to continue the meeting.
