Mayberry NOTICE OF SHERIFF'S SALE DLC#: 15-1393F By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of Rush County, Indiana, in Cause No. 70C01-1601-MF-11, wherein U.S. Bank National Association was Plaintiff, and Phyllis A. Mayberry and The Phyllis A. Mayberry Revocable Trust, Phyllis A. Mayberry, were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 7th day of Sept., 2016, at 1:30 p.m. of said day, at the 131 E. 1st St., Rushville, IN 46173, the fee simple of the whole body of Real Estate in Rush County, Indiana: A part of section nineteen (19), township fifteen (15) north, range nine (9) east, described as follows: Beginning at the southeast corner of lot number four (4) in Charles Henley's Addition to the Town of Carthage; thence north three (3) degrees sixteen (16) minutes east seventy and twenty-eight hundredths (70.28) feet along the East line of said lot number four (4) and lot number three (3) to an iron pipe; thence south eighty-one (81) degrees thirty (30) minutes east one hundred forty-one (141) feet to an iron pipe; thence south three (3) degrees sixteen (16) minutes west four (4) feet; thence south eight (8) degrees thirty (30) minutes west sixty-six (66) feet to a road nail on the north boundary of twelve (12) feet alley; thence north eighty-one (81) degrees thirty (30) minutes west one hundred thirty-five (135) feet along said north boundary to the point of beginning, containing nine thousand six hundred sixty-eight (9,668) square feet, more or less. 70-02-19-184-012.000-009 and commonly known as: 8 South Walnut Street, Carthage, IN 46115. Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 70C01-1601-MF-11 in the Circuit Court of the County of Rush Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien. Said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid.
