NOTICE TO CITIZENS AND PROPERTY OWNERS OF PUBLIC HEARING RE: JEROME D. SMITH TILE REPLACEMENT PROJECT #19-038 Notice is hereby given that the Elkhart County Drainage Board has scheduled a Public Hearing for 9:30 A.M. on Tuesday, September 10, 2019, in Room A of the County Public Services Building, 4230 Elkhart Road, Goshen, Indiana (U.S. 33 @ C.R. 26) for consideration of the JEROME D. SMITH TILE REPLACEMENT PROJECT #19-038. It is the landowner's responsibility to advise any renters of their property or lands being sold under land contract of this notice. The project is located north of CR 54, west of CR 15 and extends a half mile North of CR 52 in Section 26 of Union Twp. The scope of work begins at the top end of the open ditch on the NE side of Yoder's woods, at the outlet of the tile portion. The project consists of replacing 4,200 LF the existing 12 clay tile with 500 LF of 24, 1,850 LF of 18 and 1,600 LF of 15 polyethylene corrugated tile and the installation of 5 MH structures. The route of the tile will be relocated to run in a north/south direction. Sections of the existing tile not disturbed by the new line will be abandoned as a regulated drain by the Elkhart County Drainage Board to be maintained by the landowners. These sections will be connected to the new line at the downstream points. The project is to be completed by the Winter of 2019. NO CROP DAMAGES are proposed to be paid in the project area. The estimated cost of the project is less than $200,000.00. It is the Contractor's responsibility to work around or remove and reset all maintained fences in the project area. If a maintained fence is destroyed or cannot be reset, the contractor shall install the same type of fence at his expense. Non maintained fences will not be replaced. Property owners should be aware that Cumulative Drainage funds will be used to finance the County's portion of the project and that no ditch maintenance assessments against property owners are contemplated. Interested property owners and concerned citizens will be given an opportunity to present their views on the project and claim damages as they might accrue from said project, at the scheduled hearing. Plans and specifications on the project may be reviewed at the Office of the Elkhart County Surveyor.
