SUMMONS - SERVICE BY PUBLICATION CAUSE NO. 20D03-1605-AD-38 IN THE ELKHART COUNTY SUPERIOR COURT FOR THE STATE OF INDIANA, COUNTY OF ELKHART, SS: IN THE MATTER OF THE ADOPTION OF : MARTIN IBARRA JR., Minor Child. NOTICE OF ADOPTION MARTIN IBARRA DE LA ROSA, whose whereabouts are unknown, is hereby notified that a Petition for Adoption of a minor child father by Martin Ibarra de la Rosa named MARTIN IBARRA JR., born May 8, 1999 to the minor child's natural mother, MARIA IGNACIA AMATON REYES (who is married to the Petitioner), in Goshen, Indiana, has been filed by Petitioner, Alejandro Vivero Pedroza, in the office of the Clerk of Elkhart County Courts, 101 North Main Street, #204, Goshen, Indiana 46526, in a cause captioned In the Matter of the Adoption of Martin Ibarra Jr., under Cause No. 20D03-1605-AD-38. The Petition for Adoption alleges Martin Ibarra de la Rosa allegedly deserted the child more than six (6) months immediately prior to the date of filing of the Petition; that he has failed to communicate with the child when able to do so; and the he has knowingly failed to provide for the care and support of the child when able to do so. If Martin Ibarra de la Rosa seeks to contest the adoption of Martin Ibarra Jr., by the Petitioner, he must file a motion to contest the adoption in accordance with Indiana Code 31-19-10-1 in the above-named court not later than thirty (30) days after the date of publication of this notice. If Martin Ibarra de la Rosa does not file a motion to contest the adoption within thirty (30) days after publication of this notice the above-named Court will hear and determine the Petition for Adoption. The consent to the adoption of Martin Ibarra Jr. will be irrevocably implied and Martin Ibarra de la Rosa will lose the right to contest either the adoption or the validity of his implied consent to the adoption. No oral statement made to Martin Ibarra de la Rosa relieves him of his obligations under this Notice. This Notice complied with Indiana Code 31-19-4.5-3 but does not exhaustively set forth a person's legal obligations under the Indiana adoption statutes. A person being served with this Notice should consult the Indiana adoption statutes.
