AMENDING ORDINANCE NO. 2015-BC-O-04 ORDINANCE AMENDING THE MADISON COUNTY ZONING ORDINANCE ADOPTED PURSUANT TO I.C. 36-7-4-602 WHEREAS, the Board of Commissioners has adopted, pursuant to I.C. 36-7-4-602, a Zoning Ordinance, which specifies the intent, permitted uses, special uses, development standards, and other information concerning various land use districts in Madison County; and, WHEREAS, the Zoning Ordinance defines the characteristics that should define each of the County's land use districts; and WHEREAS, on May 10, 2016 the Madison County Plan Commission considered a Petition to Rezone filed on or around April 4, 2016 by Donald W. Marstall and David J Martsall which sought to have the following real estate, which is currently zoned as Single-Family Residential (R2) to General Commercial (GC): Beginning at a point 333.75 feet East of the Southwest corner of Section 4, Township 19 North, Range 8 East; and running thence North 666.19 feet; thence East 334.12 feet; thence South 665.38 feet; thence West 333.75 feet to the place of beginning, containing 5 acres, more or less. Subject to legal highways. Commonly known as: 2092 E. 100 N., Anderson, Indiana Parcel No. 48-12-04-300-126.000-033 and, WHEREAS, the Madison County Plan Commission unanimously recommended the adoption of the Petition To Rezone (Staff Report and Minutes of May 10, 2016 meeting attached hereto) and certified the positive recommendation to the Board of Commissioners, and WHEREAS, the Board of Commissioners concur with the unanimous positive recommendation of the Plan Commission and deem it desirable to grant the Petition to Rezone. NOW, THEREFORE, BE IT ORDAINED that the following real estate: Beginning at a point 333.75 feet East of the Southwest corner of Section 4, Township 19 North, Range 8 East; and running thence North 666.19 feet; thence East 334.12 feet; thence South 665.38 feet; thence West 333.75 feet to the place of beginning, containing 5 acres, more or less. Subject to legal highways. Commonly known as: 2092 E. 100 N., Anderson, Indiana Parcel No. 48-12-04-300-126.000-033 be rezoned from Single-Family Residential (R2) to General Commercial (GC).
