PUBLIC NOTICE LEGAL NOTICE OF HISTORIC EFFECT Kercher Road Reconstruction from the Norfolk Southern Marion Lind to US 33 City of Goshen, Elkhart Township, Elkhart County, Indiana Des. Nos. 1400713 & 1401747, DHPA No. 17817 The City of Goshen is developing a federal-aid project to reconstruct and widen Kercher Road to a three-lane roadway consisting of a single 12-foot travel lane in each direction with a 14-foot two-way left turn lane. The approximately 2.2-mile project would begin just west of the Norfolk Southern Railroad and extend east to US 33. In addition, the Norfolk Southern Railroad crossing will be upgraded to current standards and provide a new pedestrian crossing. In advance of the crossing, center islands would be constructed in the median to allow for pedestrian refuge accessing the Winona Interurban Trail located along the Norfolk Southern Railroad, and provide a two-lane crossing for motorists. Pine Manor Avenue would be realigned to tie into Kercher Road across from Industrial Park Drive. The aboveground Area of Potential Effect (APE) for this undertaking incorporates the project location and includes adjacent properties since this is a road improvement project. The APE for archaeological resources is defined as the footprint or project area. Historians found no properties within the project APE that had been previously recorded in the National Register of Historic Places (NRHP). However, historians recommended two properties eligible for listing in the NRHP: the John H. Violett House [Indiana Historic Sites and Structures Inventory (IHSSI) No.: 039-243-53241] and the Yoder-Koerner Farmstead (IHSSI No. 039-243-53235). INDOT, on behalf of the FHWA, has issued a No Adverse Effect finding for this project. In accordance with the National Historic Preservation Act, the views of the public are being sought regarding the effect of the proposed project on the historic elements as per 36 CFR 800.2(d), 800.3(e) and 800.6(a)(4). Pursuant to 36 CFR 800.6(a)(4), the documentation specified in 36 CFR 800.11(e) is available for inspection at American Structurepoint (7260 Shadeland Station, Indianapolis, Indiana, 46256). This documentation serves as the basis for the FHWAs No Adverse Effect finding. The views of the public on this finding are being sought. Please reply to the contact listed below. This undertaking will convert property from the Yoder-Koerner Farmstead, a section 4(f) historic property, to a transportation use; INDOT, acting on FHWAs behalf, has determine the appropriate Section 106 finding is No Adverse Effect; therefore FHWA hereby intends to issue a de minimis finding for the Yoder-Koerner Farmstead, pursuant to SAFETEA-LU, thereby satisfying FHWAs responsibility under Section 4(f) for this historic property.
